These Terms of Use apply to the Wit Happens mobile application and the website at wit.grime.net, operated by VizMAP Pty Ltd trading as Grime (“Grime”, “we”, “us” or “our”). By downloading, accessing or using Wit Happens, you agree to these terms.
Entertainment and general information
Wit Happens is provided for entertainment and general information. It is not professional, legal, medical, financial or other specialist advice. You are responsible for deciding whether any content is appropriate for your circumstances.
Quotations and attributions
The collection has been assembled from many sources over time. Quotations, wording, sources and attributions may contain errors, variations, disputed origins or material whose original source cannot be reliably established.
We welcome corrections. If you identify a suspected error, please email wit@grime.net and include enough of the quotation for us to identify it. We will review reasonable reports and make corrections where appropriate.
Acceptable use
You must not:
- use the app or website unlawfully or to harm another person;
- interfere with their operation, security or availability;
- attempt unauthorised access to systems, accounts or data;
- introduce malicious code or use automated methods that place an unreasonable load on the service;
- circumvent advertising, security or access controls; or
- reproduce, extract or distribute a substantial part of the app, collection, website, original design or original content without permission.
Intellectual property
The Wit Happens name, branding, app software, website design, original writing, graphics and other original material are owned by or licensed to Grime and are protected by applicable intellectual-property laws.
Individual quotations and other third-party material remain subject to any rights held by their respective owners. Inclusion in the collection does not claim ownership of third-party material or endorsement by its authors, performers, publishers or rights holders.
Copying and sharing
The app includes features for copying and sharing individual quotations for personal, non-commercial use. These features do not grant permission to republish substantial parts of the collection, create a competing database or use content in a way that infringes another person’s rights.
Advertising and third-party services
The app may display advertising and use third-party services, including Google AdMob, app-store services and the sharing services available on your device. The website also relies on hosting and WordPress-related services. Separate terms and privacy policies may apply to those services. Grime does not control their availability, content or practices.
Availability and changes
Wit Happens is provided on an “as available” basis. Features, content, advertising and compatibility may be corrected, changed, added, suspended or discontinued. We do not promise that the app or website will always be available, uninterrupted, secure or error-free.
Software updates may be required to continue using some features. Older operating systems or devices may not remain supported indefinitely.
No guarantee of content accuracy
Although we take reasonable care when maintaining the collection, we do not guarantee that every quotation, attribution, source, category or piece of wording is complete or accurate. Content should not be relied upon as an authoritative historical record.
Liability
To the extent permitted by law, Grime is not liable for indirect, incidental, special or consequential loss arising from use of, reliance on, or inability to use the app, website or third-party services.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law. Where liability can lawfully be limited, it is limited to the extent permitted by law.
Suspension or termination
We may restrict access to the app or website where reasonably necessary to protect security, comply with law, maintain the service or respond to misuse. You may stop using the service at any time and may uninstall the app from your device.
Changes to these terms
We may update these terms when the app, website, service providers or legal requirements change. The current version and its effective date will be published on this page. Continued use after an update takes effect constitutes acceptance of the revised terms.
Governing law
These terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them.
